The citizens of Albania who are returning to their country from USA can try and get exemption from the duties and taxes from the customs officer for the car they are importing to Albania. However, this exemption can be taken just once in a lifetime and is not applicable later. However, they are supposed to show the necessary copy of the documents at the time of import including a passport copy, an original family certificate the residential permit from the USA as well as a proforma invoice that indicates customs value of the car being imported.

Who benefits from the Temporary Admission Regime on import of a private vehicle?

• Non-resident visitors visiting Albania with their vehicles for short periods of time and leaving Albania again with their vehicles;
• Students, doctors and scientists who visit or work in Albania for certain periods of time;
• Individuals who are resident outside Albania and have a job in the Republic of Albania.

What are the general conditions of the Temporary Admission Regime on import of a vehicle for private use?

• The vehicle must have permanent registration outside of Albania;
• The vehicle may benefit from the temporary admission regime for a period of 6 months within 12 month period;
• At the end of this period, the vehicle must leave the country or be declared and cleared by the Customs Authorities. Temporary exit in neighboring countries does not serve to re-count/re-start the 6-month permission period;
• The vehicle can not be used by anyone other than the family members. The person who brought the vehicle to the country can not leave the vehicle in Albania at the moment of exit from the territory of the country;
• The vehicle can not be sold, changed ownership, or used for commercial purposes.

Attention! Beware of Smuggling

When a vehicle is temporarily registered outside the Albanian territory and at the time of entry into the territory of the Republic of Albania it is NOT declared to the Albanian Customs Authorities to carry out the transit procedures, this action is considered as “Smuggling of vehicles”;

Violation of the time limits for the use of the above mentioned vehicle and of the other conditions is considered an administrative offense and is punishable by the law;

When the offender presents himself to the Customs Authorities in order to give a destination to the vehicle for e.g. for release for free circulation, penalties are calculated to 50% of the unpaid duties;

If the offender does not present himself before the Customs Authorities and is stopped by them or by the State Police officers within six months after the expiration of the six months allowed for the Temporary Admission Regime, the penalties are calculated in the amount of 75% of the unpaid duties;

If the vehicle has violated the six-month period of temporary admission and is used by unauthorized persons, the amount of the penalty applied varies from 50,000 to 200,000 ALL.

The procedure for the clearance of vehicles included under Heading 8703 of the Combined Nomenclature of Goods (motor vehicles and other motor vehicles principally designed for the transport of up to 9 persons) is the same as for the other goods.

Customs duties for these vehicles consist only of the Value Added Tax (VAT) which applies to the Customs value of the imported vehicles. The customs value consists of the value of the purchase of the vehicle, as well as the possible adjustments when necessary.

If, on the basis of reasonable doubt, Customs value can not be established then it shall be calculated on other methods of Customs valuation. The method that has been found to be wider in such cases is that of the “Available Data File”.

Liability insurance must be obtained locally (with Embassy assistance) and is reasonably priced. Comprehensive insurance may be obtained locally or from U.S. companies that insure internationally.

In view of the difficulty getting parts for American-made cars, European-spec cars are recommended unless Embassy personnel bring adequate spare parts for the American-made vehicle. It is possible to purchase parts in Italy and Greece (See caveats elsewhere about travel), and diplomats may bring parts into the country duty free. Although repair parts are difficult to obtain in-country, repair service is available in Tirana and availability is increasing. Recently Volkswagen, Opel, and Mercedes have opened repair shops in Tirana. If employees choose to purchase vehicles locally, it is necessary to insure that vehicles have the proper documentation since the sale of stolen vehicles is extremely common in Albania. Unleaded gasoline and diesel are available for purchase at the Embassy. The number of local filling stations is increasing and companies such as BP and Api currently operate in Tirana.
